Tax Authorities Drop Their Demand for Rs. 7 Cr in Service Tax Against CCI

<p>The Competition Commission of India (CCI) has been released from a Rs 7.08 crore service tax demand by the GST authorities, who claim the statutory body does not provide any taxable services.</p>

<p>In response to an appeal brought by the competition watchdog against the show-cause notice issued by the Directorate General of GST Intelligence (DGGI), Delhi zone, the CGST commissioner audit issued a decision.</p>
<p>Based on a “intelligence report” indicating that the CCI is not paying service tax on the fees or consideration it got while rendering services to different individuals, the DGGI issued a show cause notice in 2020.</p>
<p>According to the show-cause letter, the CCI was charging fees to individuals or businesses that contacted them for acquisitions, mergers, or amalgamations, but who had not yet registered under the Finance Act or paid off their service tax obligation.</p>
<p>Subsequently, the CCI petitioned the Commissioner of CGST & Central Excise, Delhi Audit-1, the adjudicating authority, and won a favorable decision.</p>
<p>According to the adjudicating authorities, the CCI is an organization established by a parliamentary act, and the CAG audits its financial statements.</p>
<p>There are no taxable services provided by the CCI.</p>
<p>The decision dropped the service tax claim of Rs 7.08 crore, stating that “therefore the liability related to non-filing of return doesn’t arise.”</p>
